Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of the website located at www.bertiesontherec.com (the “Site”), which is operated by On the Rec Limited, trading as “Bertie’s” ("we", "us", "our"). Please read these Terms carefully before using the Site. By accessing, browsing or otherwise using the Site you confirm that you have read, understood and agree to be bound by these Terms.

1. Information About Us

1.1  On the Rec Limited is a company registered in England and Wales (company number 16368660) with its registered office at Station House, Station Approach, East Horsley, Surrey, KT24 6QX and principal place of business at Bertie’s, The Claygate Pavilion, Dalmore Avenue, Surrey, KT10 0HQ.

1.2  The landlord, the Claygate Recreation Ground Trust, holds a premises license under the Licensing Act 2003 permitting the sale of alcohol for consumption on and off the premises. We operate a “Challenge 25” policy and reserve the right to refuse service where we reasonably believe a customer is under 18 and cannot provide acceptable proof of age.

2. Acceptance of These Terms

2.1  If you do not agree to these Terms, you must not use the Site.

2.2  We may amend these Terms from time to time. Any changes will be posted on this page and are effective from the “Last updated” date shown above. Your continued use of the Site after changes have been made constitutes acceptance of those changes.

3. Other Applicable Terms

3.1  These Terms refer to the following additional documents, which also apply to your use of the Site:

  • Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you or that you provide to us.

  • Our Cookie Policy, which sets out information about the cookies on the Site.

4. Accessing the Site

4.1  We do not guarantee that the Site, or any content on it, will always be available or uninterrupted.

4.2  We may suspend, withdraw or restrict the availability of all or any part of the Site for business or operational reasons without notice.

4.3  You are responsible for ensuring that all persons who access the Site through your internet connection are aware of these Terms and comply with them.

5. Intellectual Property Rights

5.1  We are the owner or licensee of all intellectual property rights in the Site and in the material published on it. Those works are protected by copyright and other intellectual property laws and treaties around the world. All such rights are reserved.

5.2  You may print off one copy and download extracts of any page(s) from the Site for your personal, non‑commercial use. You must not modify the paper or digital copies in any way, nor use any illustrations, photographs, video, audio or graphics separately from accompanying text.

5.3  You must not use any part of the content on the Site for commercial purposes without obtaining a licence to do so from us or our licensors.

6. Prohibited Uses

6.1  You may use the Site only for lawful purposes. You may not use the Site:

  • In any way that breaches any applicable local, national or international law or regulation.

  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.

  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material (spam).

  • To knowingly transmit any data, send or upload any material that contains viruses or any other harmful programs designed to adversely affect the operation of any computer software or hardware.

7. Ordering & Purchases Through the Site

7.1  Where the Site enables you to place orders for food, drink, vouchers or merchandise (collectively “Products”) the following additional terms apply.

7.2  The display of Products on the Site constitutes an invitation to treat and not a contractual offer. Your order is an offer to purchase the selected Products subject to these Terms.

7.3  After you place an order, you will receive an email acknowledging receipt. A contract is formed only when we send a further email confirming acceptance and dispatch or collection details.

7.4  Prices are set out on the Site and include VAT unless stated otherwise. Delivery or service charges (if applicable) will be shown separately before checkout.

7.5  Payment must be made using the methods specified on the Site. All card payments are processed securely by our third‑party payment providers. We do not store complete card details.

7.6  Your statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply to perishable food items or sealed items which have been unsealed.

8. Reservations & Events

8.1  Where you make a reservation or booking through the Site, your booking is not confirmed until you receive a confirmation email.

8.2  We reserve the right to require a deposit or card details to secure certain bookings and to apply cancellation or no‑show charges, details of which will be notified to you at the time of booking.

9. Gift Vouchers

9.1  Gift vouchers purchased via the Site are valid for 12 months from the date of issue unless stated otherwise. Vouchers are non‑refundable and may not be exchanged for cash.

9.2  Lost, stolen or destroyed vouchers will not be replaced.

10. Allergens & Dietary Requirements

10.1  We take allergens seriously. However, all our food is prepared in a kitchen where allergens are present. If you have any allergies or dietary requirements, please inform us before ordering.

11. Limitation of Liability

11.1  Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

11.2  Subject to clause 11.1, we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with:

  • use of, or inability to use, the Site; or

  • use of or reliance on any content displayed on the Site.

11.3  We supply Products for domestic and private use only. If you use Products for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

12. Links to Third‑Party Sites

12.1  Where the Site contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources.

13. Governing Law & Jurisdiction

13.1  These Terms, their subject matter and formation are governed by the laws of England and Wales.

13.2  You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that, if you are a consumer resident in Northern Ireland, you may also bring proceedings in Northern Ireland, and if you are resident in Scotland you may also bring proceedings in Scotland.

14. Complaints & Alternative Dispute Resolution

14.1  If you have a complaint, please contact us first so that we can try to resolve the issue. You can reach us using the details in clause 15.

14.2  If we are unable to resolve a dispute, you may wish to use the EU Online Dispute Resolution platform available at http://ec.europa.eu/odr.
